Spring business sued over contract
A company in Cy-Fair is suing after, it says, a Spring business pocketed money that was to be used to purchase a company car.
Applied Finish Systems of Cy-Fair and Wayne Martin filed a lawsuit on Feb. 18 in the Harris County District Court against Spring-area Robert Simms, Debbie Sims and RDS Consultants, alleging fraud, breach of contract, violations of the Texas Theft Liability Act and conspiracy.
The plaintiff says that Aug. 2, 2010, it gave the defendants a $51,000 advance payment to help grow its business and oversee its “Regency Apartments” project. According to the brief, the defendants deposited the $51,000, yet neglected the “Regency Apartments” project, then requested $30,000 to purchase a company car, yet failed to buy the car as agreed and pocketed the money.
Applied Finish is seeking actual, punitive and statutory damages, as well as attorney’s fees and court costs. It is being represented in the case by Bellaire attorney Mark Levine.
