Spring couple sued over 'eyesore'
Spring residents are being sued over claims that junk cars are wrecking property values in their neighborhood.
Bammel Forest Civic Club filed a lawsuit on March 21 in the Harris County District Court against Spring residents Edward and Jessica Wauters, alleging violations of deed restrictions.
Bammel Forest says that since Jan. 15, 2010, the defendants have refused to respond to demands that they remove the broken-down vehicles they keep on their property. According to the brief, these vehicles constitute a nuisance, an annoyance and an eyesore to the Bammel Forest Community.
The plaintiff is seeking injunctive relief, damages in the amount of $200 for each day the defendants violate this deed restriction, attorney’s fees and court costs. It is being represented in the case by Houston attorney Michael Gainer.
