Spring resident sued over rubbish
A homeowners association is suing after, it says, a resident in its Spring neighborhood creates a nuisance by storing rubbish in his driveway and yard.
Dove Meadows Homeowners Association filed a lawsuit on June 24 in Harris County District Court against Spring resident Victor Mejia, citing violations of the Texas Property Code.
The Association says that Mejia is in violation of the Dove Meadows subdivision's restrictive covenants by running multiple garage sales and storing such items as TVs, bikes, a refrigerator and coolers in the driveway and the yard of his home, located at Greenham Drive in Spring. According to the brief, this nuisance is lowering property values in the neighborhood.
The Association is seeking injunctive relief, asking the court to fine Mejia $200 a day for every day he is in violations of its restrictive covenants, damages, attorney's fees and court costs. It is being represented in the case by Houston attorney Michael Gainer.
